01Parties and Acceptance

These Terms of Service (the “Terms“) govern the relationship between Mert Kuştul (“we“), operator of the Waycon mobile app (the “App“), and the person who downloads or uses the App (“you“). By downloading, creating an account or using the App you accept these Terms. If you do not accept them, do not use the App.

02The Service

The App offers the following core features:

Voice channels: public/private channels where riders talk in real time; optional live location sharing in private channels.
Ride recording and route sharing: record your rides, see their statistics and publish eligible rides as public routes; discover, like and save other users’ routes.
Community: user search, follow and public profiles.
Garage: record your vehicles (make/model/mileage/fuel consumption), track expenses and receive maintenance reminders.
Safety: crash detection, emergency contact and emergency call/SMS shortcuts; weather alerts.
Accident Report (KTT) Assistant: after an accident, record details, narration, photos and a sketch and export a PDF; includes AI-assisted field/sketch suggestions (see §7).
Share links: share channels, routes, profiles and invites with waycon.app links.
End-of-ride share card: create a visual summary of your ride on your device (with a QR code for published routes) and share it in the app of your choice.
Motor Wallet: reminders for inspection, traffic insurance, kasko and MTV expiry dates (Türkiye); registration renewal, insurance and inspection (US/other markets); an informational MTV estimate based on engine size in Türkiye.
Group rides: a meeting point set by the channel owner; “Find a service” links to brand service pages and fuel consumption information.

03Account and Eligibility

You must sign in with your Apple or Google account to use the App.
If you are under 16 you may not use the App.
You are responsible for all activity on your account; report suspected unauthorised use to info@waycon.app immediately.

04Plans, Subscriptions and Payments

Core features are free. Some features and quotas (e.g. voice minutes, public channels, emergency contact, weather alerts, AI quota) require a paid plan (Rider, Leader). Route sharing, public profiles and following are available on every plan. Plan contents are shown in the App and may change.
Purchases are made through the Apple App Store or Google Play; payment, cancellation and refunds are governed by that store’s rules. Subscriptions renew automatically unless you cancel in your store settings at least 24 hours before the period ends.
We verify subscription status through RevenueCat. When paid entitlements expire, the related features are restricted.

05User Content and Conduct

In voice channels, route titles, usernames or anywhere in the App you may not:

Share unlawful, threatening, harassing, discriminatory or obscene content,
Infringe others’ intellectual property or personality rights,
Use the App for spam, fraud or abuse,
Collect or disclose another user’s personal data without consent (outside KTT),
Publish fake, misleading or manipulated route/ride data.

If a violation is found, content may be removed and your account warned, suspended or closed. You can block and report inappropriate users.

06Routes You Publish

When you publish a route, its track, title, difficulty and statistics become visible to all users; you grant us a limited, non-exclusive licence to display this content as part of the service. You can unpublish at any time.
To be shareable, a ride must be at least 3 km and contain enough GPS points.
Riding a route is at the rider’s own risk; we give no warranty on route safety, road/traffic conditions or legal suitability. Every rider must follow traffic rules and road conditions.

07IMPORTANT — Nature of the Accident Report (KTT) Assistant and Disclaimer

The KTT Assistant is NOT an official accident report. This feature:

Is not a legally binding official document towards insurers, SBM or law enforcement under traffic law or related legislation,
Is provided only as a personal reference and memory aid to collect information in an organised way and export it as a PDF,
May be submitted to authorities as a supplementary explanatory document but does not on its own replace the legal report.

AI suggestions can be wrong. Field and sketch suggestions are produced by the Anthropic Claude model and carry no accuracy guarantee. Verifying and correcting them is your responsibility. Mert Kuştul is not liable for consequences of an incorrect/incomplete report.

In a real accident: if there is injury or serious damage, call 112 (911 in the US) or the police first; this App does not replace those steps.

08Crash Detection, Emergency Features and Weather Alerts

Crash detection relies on the phone’s motion sensors and does not guarantee detecting every crash or that every detection is a real crash (false positives and negatives can occur). Phone mounting, battery, permissions and signal affect the result.
The App is not an emergency service. It only makes it easier to start a call or an SMS draft; making the call and confirming sending are your responsibility.
Weather alerts and maintenance reminders are informational; they rely on third-party data and values you enter, and accuracy and timely delivery are not guaranteed. The vehicle manufacturer’s instructions prevail for maintenance. Motor Wallet document reminders and the MTV estimate are also informational; they are not an official notice, calculation or collection, and verifying document deadlines and tax amounts with the relevant authorities is your responsibility. Not receiving a reminder does not remove your document obligations.

09Responsibility for Entering Third-Party (Party B) Data

When you enter the other party’s personal data in KTT you alone are responsible for its accuracy and for the legal/ethical responsibility of entering it (see Privacy Policy §7). Mert Kuştul does not verify its accuracy or legitimacy.

11Intellectual Property

The App’s design, code, logo and brand belong to Mert Kuştul. You keep your rights in the content you share, but you permit us to process it as necessary to provide the service (upload to servers, route display, AI analysis, etc.).

12Termination

You can delete your account at any time in Settings (Profile → Settings → Account Settings) or by following the Delete Account page on waycon.app. If you breach these Terms we may suspend or terminate your account without prior notice.

13Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE“. No express or implied warranty is given that it will be uninterrupted, error-free or fit for a particular purpose. We are not responsible for interruptions in third-party infrastructure such as voice (LiveKit), AI (Anthropic), maps, weather or payments.

14Limitation of Liability

To the maximum extent permitted by law, Mert Kuştul is not liable for indirect, incidental, special or consequential damages (including but not limited to loss of profit/data, accident/injury) arising from the use of, or inability to use, the App. Our total liability for direct damages, if any, is limited to the amount you paid for the App in the last 12 months.

15Indemnification

You agree to indemnify Mert Kuştul against claims by third parties arising from your breach of these Terms or misuse of the App.

16Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. For users resident in Türkiye the Istanbul courts and enforcement offices are competent. Mandatory provisions of consumer law remain reserved.

17Changes

We may update these Terms from time to time and will notify you in the App of material changes. Continuing to use the App after an update means you accept the new Terms.
